These Terms and Conditions
(hereinafter referred to as the "Terms") govern the rights and
obligations related to the use of services provided through the website www.hamili.cz (hereinafter
referred to as the "Website") operated by KáDéčko Bar & Grill
s.r.o. (hereinafter referred to as the "Operator"), particularly in
connection with the ordering and delivery of food and beverages (hereinafter
referred to as the "Services").
1. Introductory Provisions

1.2 User
The User is a natural or legal
person who uses the Services through the Website (hereinafter referred to as
the "User"). The User may be a consumer (as defined in Section 419 of
the Civil Code) or an entrepreneur.
1.3 Subject of Services
The Operator, through the
Website, facilitates and provides the delivery of food and beverages from
partner restaurants or its own establishments based on Users' orders.
2. Conclusion of the Contract
2.1 Order
- The User places an order through the Website by completing the order form.
- The order becomes binding when the User confirms the order by clicking the "Submit Order" button or a similar method.
- Before submitting the order, the User is obliged to verify the accuracy of the provided information, particularly the delivery address, contact details, and order contents.
2.2 Order Acceptance
- After submitting the order, the User will receive confirmation of order receipt at the email address provided in the order.
- The contract between the Operator and the User is concluded upon the Operator's confirmation of the order.
2.3 Order Rejection
The Operator reserves the right
to reject an order, particularly if:
- The goods are unavailable,
- The delivery address is outside the Operator’s service area,
- The order contains clearly incorrect information,
- The User has repeatedly violated these Terms.
3. Prices and Payment Terms
3.1 Prices of Goods and Delivery
- The prices of goods are listed on the Website, including VAT, and are valid at the time of order submission.
- The delivery fee is specified when placing the order and may vary depending on the location and distance.
- The Operator reserves the right to change prices, but such changes do not affect already confirmed orders.
3.2 Payment Methods
- Payment can be made using the payment methods listed on the Website (e.g., online card payment, cash on delivery, etc.).
- For cash payments, the User must prepare the exact amount to facilitate accurate change.
3.3 Invoicing
- A tax document is issued electronically and sent to the User’s email address, unless otherwise agreed.
4. Delivery Terms
4.1 Delivery Time
- The estimated delivery time is provided when placing the order. This is an indicative time and may be affected by factors such as restaurant workload, traffic conditions, or adverse weather.
- The Operator is not liable for delays caused by circumstances beyond its control.
4.2 Delivery Location
- The goods are delivered to the address specified by the User in the order.
- The User is responsible for ensuring the presence of a person authorized to receive the goods at the specified address during the delivery time.
4.3 Receipt of Goods
- The User must inspect the goods upon receipt. If the goods are damaged or do not match the order, the User must immediately notify the delivery person and contact the Operator.
5. Rights and Obligations of the
User
5.1 User’s Rights
- The User is entitled to the delivery of goods in accordance with the order and these Terms.
- If the User is a consumer, they are entitled to information and protection under consumer protection laws.
5.2 User’s Obligations
- The User must provide accurate and complete information when placing an order.
- The User is obliged to receive the goods at the specified address and pay the order amount, including delivery fees.
6. Withdrawal from the Contract
6.1 Withdrawal by the Consumer
- Due to the nature of the goods (perishable food), the consumer cannot withdraw from the contract without reason within 14 days, as stipulated in Section 1829 of the Civil Code, as the goods are subject to rapid spoilage (Section 1837(d) of the Civil Code).
6.2 Withdrawal for Other Reasons
- If the goods do not match the order or are defective, the User has the right to file a complaint (see Section 7).
- An order can be canceled before its confirmation by the Operator by contacting customer support.
7. Complaints
7.1 Complaint Conditions
- A complaint can be made if the goods do not match the order, are damaged, or exhibit defects.
- Complaints must be submitted without undue delay after receiving the goods via email at info@hamili.cz or by phone at +420 482 311 111.
7.2 Complaint Resolution
- The Operator will resolve the complaint without undue delay, no later than 30 days from its submission, unless otherwise agreed with the User.
- In the case of a justified complaint, the User is entitled to a replacement of the goods, a refund, or other compensation as agreed.
8. Personal Data Protection
8.1 Processing of Personal Data
- The Operator processes the User’s personal data in accordance with GDPR (EU) 2016/679 and Act No. 110/2019 Coll., on personal data processing.
- Details on personal data processing are provided in the Privacy Policy available on the Website.
9. Final Provisions
9.1 Changes to the Terms
- The Operator reserves the right to amend these Terms. Changes take effect on the date of their publication on the Website.
- The User is obliged to familiarize themselves with the current Terms before each order.
9.2 Governing Law and
Jurisdiction
- These Terms are governed by the laws of the Czech Republic.
- Any disputes will be resolved before the competent court in the Czech Republic.
